In accordance with the terms of section 22(2) of Spanish Law 34/2002 of 11 July on information society services and electronic commerce following its amendment by Spanish Royal Decree-Law 13/2012 of 30 March transposing EU directives on internal electricity and gas markets and electronic communications and adopting measures to correct imbalances between costs and revenues in the electricity and gas sectors, which provides as follows:
““Service providers may use data storage and retrieval devices on users’ terminals, provided that the users have given their consent after being provided with clear and comprehensive information on their use, in particular on the purposes of the data processing, in accordance with the terms of Spanish Organic Law 15/1999 of 13 December 1999 on the Protection of Personal Data.
Where technically possible and effective, the user’s consent to the processing of data may be provided through the use of the appropriate settings of the browser or other applications.
This will not prevent any technical storage or access for the sole purpose of carrying out the transmission of a communication over an electronic communications network, or as strictly necessary in order to provide an information society service explicitly requested by the user.”
